6:50:10 PM Gulledge Called the third public hearing of Wednesday, March 7, 2007 to order. There were fifteen (15) people in attendance. He explained the purpose of the hearing is to discuss an annexation agreement between the Village and Wynncrest Corporation for property commonly known as Timber Creek Estates. He asked the attorney to discuss.
6:50:45 PM Wigginton Stated this annexation pertains to approximately 85.94 acres of ground located off of Keebler Road. Explained pursuant to negotiations with the developer, the Village has agreed to annex the property as SR1. Explained there will be certain lots granted a variance as a condition of the agreement. Stated those lots are referenced in the annexation agreement as well as in the minutes of the Zoning Hearing. Stated the developer is also granted a variance from the Village ordinance prohibiting cul-de-sac roads in excess of 1,000 feet. Stated the developer is also granted a variance allowing him to construct a private street known as Oak Bluff Court. Stated these variances have been the subject of prior hearings held February 26 in front of the Village Planning Commission and this evening in front of the Village Board. Explained regarding the private street, the developer will be responsible for the construction, repairs and all utility bills associated with street lighting; the street will be gated to which the Village will have access. Stated the developer is not required to construct sidewalks along this private street nor on one other street known as Stonebridge Bluff Drive. Stated the developer has agreed to comply with all other Village ordinances and pay all fees contained on the Village schedules. Stated all public improvements will be dedicated to the Village. Stated if the Village fails to pass the ordinance granting the zoning of SR1 with certain variances, the developer has the right to de-annex at which time the agreement would become null and void. Asked for any questions.
6:53:10 PM Bell Clarified this is a private road. Gulledge explained for six of the lots. Bell clarified they are SR1 lots.
6:53:22 PM Wigginton Explained one road within the 126 lot development will be a private street, gated with cobblestone concrete surface.
6:53:39 PM Bell Clarified that street does not require sidewalks.
6:53:45 PM Wigginton Answered that is correct because of the topography, which is one of the reasons it will be a private street because it could not meet Village requirements in terms of width.
6:53:51 PM Gulledge Explained its entrance is to the original Stonebridge development and there are no sidewalks there, so if they were required the sidewalks would lead to nowhere.
6:54:02 PM Wigginton Explained this is the same situation with the other street that is accessed via Stonegate Estates, which will be constructed and known as Stonebridge Bluff Drive. Stated that particular portion of that subdivision has no sidewalks, so the Village felt it was not necessary to require the developer to construct sidewalks because they would lead to nowhere.
6:54:30 PM Gulledge Explained the other lots in the development all have sidewalks, which will access the sidewalks on Keebler Road. Asked for other questions. There were none.
6:54:54 PM   He closed the hearing.
