6:50:38 PM Gulledge Called the July 7, 2004 public hearing to discuss changes to the Village of Maryville Subdivision Codes to order. He said they will be taking up in the regular meeting to follow, an Ordinance for the Village of Maryville amending the subdivision code and providing for access ways between subdivisions and from subdivisions to parks and trails. He asked Attorney Wigginton if comments brought up at the other public hearings on this matter should be mentioned.
6:51:40 PM Wigginton Replied that the Board should be aware that there were some suggestions made at the Planning Commission regarding whether the Village should have the discretion to require asphalt or concrete on the trails. There was also a discussion of the Planning Commission as to whether or not the Village should require bollards or barriers between the access ways and the public street. He said he has revised the ordinance since these discussions to maintain that the Village will determine whether the access way is asphalt or concrete. With respect to the bollards, he put in a new sentence that states the Village has the right to require the subdivider or developer to construct bollards on the access ways. Not that they are required, but if the Village feels a particular location needs it, they have the right to require it. He feels this will give the Village more flexibility, depending upon the location of the access way.
6:53:17 PM Bell Commented as long as it is for a bike trail, so there can be no vehicles on the trail.
6:53:19 PM Gulledge Replied it will be at their discretion. He thinks Attorney Wigginton has it worded correctly.
6:53:30 PM Schmidt Asked if the access way width was kept at six feet.
6:53:40 PM Gulledge Answered, and Wigginton concurred, that it is eight feet, not six. He asked if anyone in attendance had any questions or comments.
6:53:46 PM Garcia Commented that she would like to see that they would be concrete streets.
6:53:58 PM Gulledge Explained that this is not streets. This is concerning the access ways to the walking path and bike trail.
6:54:07 PM   There were no more questions or comments. The hearing was closed.
